Terms of Service

1. Acceptance of terms

By downloading, installing, or using Breakly ("the app"), you agree to these Terms of Service. If you do not agree, do not use the app.

2. Description of service

Breakly is an iOS app that helps golfers read putting greens by calculating aim offsets based on inputs including putt length, green speed, and slope. The app uses device sensors to measure slope and provides a visualization of the suggested aim point.

3. Subscriptions and pricing

The core green-reading feature of Breakly requires Breakly Premium, an auto-renewable subscription sold through the Apple App Store. Breakly Premium is offered in two durations:

• Monthly, billed each month
• Yearly, billed each year and including a 7-day free trial for new subscribers

The exact price for each plan is shown in the app and on the App Store at the time of purchase, in your local currency. By subscribing you agree to the following terms, which match Apple's standard auto-renewable subscription rules:

• Payment is charged to your Apple ID account when you confirm the purchase.
• The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple ID account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you selected.
• If you start the yearly plan with a free trial, any unused portion of that trial is forfeited if you purchase the subscription before the trial ends.
• You can manage or cancel your subscription at any time in your Apple ID subscription settings (the Settings app, your name, Subscriptions). Uninstalling the app does not cancel your subscription.

We do not process payments ourselves and never receive your payment details. All billing, renewals, refunds, and cancellations are handled by Apple. Refund requests are subject to Apple's policies.

Some early-access users were granted permanent free access to Breakly. If that applies to your account, it remains in effect and no subscription is required for you to use the app.

4. Accuracy disclaimer

Breakly provides aim recommendations based on mathematical models calibrated against empirical measurements. The app is a guide, not a guarantee. Actual putt outcomes depend on many factors beyond the app's control, including green condition, wind, ball type, putter face angle, and stroke tempo.

Use Breakly as one input alongside your own judgment. We do not guarantee that following the app's recommendations will result in successful putts or improved scores.

5. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app
• Use the app to violate any applicable laws or regulations
• Access or attempt to access other users' accounts or data
• Use the app in a way that could damage, disable, or impair the service

6. Account and authentication

You must sign in with Apple to use Breakly. You are responsible for maintaining the security of your Apple ID. We are not liable for any loss resulting from unauthorized access to your Apple ID.

7. Intellectual property

Breakly, including its name, logo, design, and code, is the intellectual property of Anton Gonzalez. The app is licensed to you, not sold.

Your license to use Breakly is the Licensed Application End User License Agreement (Apple's standard EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms of Service add to that agreement and govern where they provide additional or differing terms. In summary, you are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes, and you may not sublicense, resell, or commercially exploit the app.

8. Termination

We may suspend or terminate your access to the app if you violate these terms. You may stop using the app at any time by uninstalling it.

9. Limitation of liability

To the maximum extent permitted by law, Breakly and its creator are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to golf score, financial loss, or injury.

Our total liability for any claim related to the app shall not exceed the amount you paid us in the preceding 12 months.

10. Changes to terms

We may update these terms from time to time. Material changes will be communicated within the app. Continued use after changes constitutes acceptance.

11. Governing law

These terms are governed by the laws of Sweden. Disputes shall be resolved in Swedish courts, or through the EU Online Dispute Resolution platform where applicable.
